Section 79
Protection of employees

(1) In relation to any work performed by an employee in the performance of his/her position, a case cannot be filed against him/her without complying with the procedure as per sub-section (2).
(2) According to sub-section (1), the permission of the Secretary General should be obtained in case of a criminal case and in the case of a civil case, it should be as follows:-
(a) the cause of action and the name and address of the plaintiff and his heirs, if any, written notice to the Secretary General or to the relevant staff of the Legislature-Parliament Service or registered and sent by post and a copy of the same has been submitted to the Secretariat for more than two months,
(b) The case has been filed within eight months of the cause of action.
(3) An employee may not be sued for any work done in the performance of his position during his tenure, even after termination of his tenure, without approval as per sub-section (2) and (3).
(4) If permission is given to prosecute the case according to sub-section (3), his defense will be done by the Secretariat.
